Clipper and the explicit access bargain

The Escrowed Encryption Standard published as FIPS 185 in 1994 specified the SKIPJACK algorithm together with a Law Enforcement Access Field, or LEAF, inside a key-escrow system. Under that architecture, encrypted telecommunications could be decrypted when surveillance was lawfully authorized and the escrow conditions were met.

This is one of the clearest moments in the whole history.

The government was no longer merely accused of wanting hidden influence. It was openly proposing strong encryption with built-in recoverability.

Why Clipper became a privacy disaster

Clipper failed politically because it clarified the bargain too well.

The bargain was:

Later NSA guidance preserved this idea through the Commercial National Security Algorithm Suite, or CNSA. NSA’s public FAQs say CNSA algorithms, previously known as Suite B, are approved by NIST and include commercial algorithms for confidentiality, key exchange, digital signature, and hashing capable of protecting national security systems up through top-secret use in the relevant architecture.

This is historically important.

Because it shows that “approved encryption” could also mean something privacy advocates often wanted: use of strong, public, non-secret algorithms rather than proprietary or escrowed designs.

Why Suite B did not solve the trust problem

Even so, Suite B did not permanently settle trust.

The Dual_EC_DRBG controversy is the point where post-AES confidence cracked.
